These Terms of Use (“Terms”) govern your access to and use of the BetrMind mobile application and related services (together, the “Service”). By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service in one paragraph
BetrMind offers a structured space for thinking and decision support, including voice input and AI-assisted responses. It is not therapy, legal advice, financial advice, or emergency help. It is a tool — useful, we hope, but not a substitute for professional care where that is required.
2. Who you are contracting with
The Service is provided by New Trend Technology (“we”, “us”). Contact details appear on the Contacts page.
3. Eligibility and acceptable use
You must comply with applicable laws and with platform rules (such as Apple’s App Store terms). You agree not to misuse the Service — for example, by attempting to interfere with its operation, scrape it in violation of law, or use it to harm others. The Service is not designed for user-to-user sharing; do not attempt to repurpose it as a messaging hub between third parties.
4. Voice, microphone, and your device
Voice features require microphone permission on your device. You control that permission through system settings. You are responsible for where and how you speak into the app; avoid sharing confidential information aloud in unsafe environments.
5. AI-generated content (OpenAI)
Portions of the experience may use AI-generated text powered by OpenAI or similar technologies. AI output can be incorrect, incomplete, or unsuited to your situation. You remain responsible for decisions you make after using the Service. Do not rely on the Service as your only source of information for high-stakes choices without independent verification.
6. Third-party services
The Service may rely on third-party components, including but not limited to: Singular (analytics), OneSignal (push notifications, where enabled), and infrastructure providers necessary to run a modern app. Those services are governed by their own terms and privacy practices. 7. Intellectual property
The Service, its branding, and its content (excluding content you supply) are owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable license to use the Service on your devices in line with these Terms. You may not copy, modify, or resell the Service.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ZERO IF THE SERVICE IS FREE.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law.
10. Indemnity
You agree to defend and indemnify us against claims arising from your misuse of the Service, your violation of these Terms, or your violation of third-party rights — to the extent permitted by law.
11. Suspension and termination
We may suspend or discontinue the Service, or restrict access, where reasonably necessary for security, legal compliance, or operational reasons. You may stop using the Service at any time by uninstalling the app.
12. Changes to these Terms
We may update these Terms. We will indicate the new effective date at the top. If you continue to use the Service after changes take effect, you accept the updated Terms. If you disagree, discontinue use.
13. Governing law
These Terms are governed by the laws applicable to New Trend Technology’s operations, excluding conflict-of-law rules that would send the dispute elsewhere. Courts in the appropriate venue shall have jurisdiction, unless mandatory consumer protections in your country say otherwise.
